can the mother change the babies last name without the fathers contsent

No, the mother must have the approval of the father unless he has commited a felony or disowned the child.
Reply:Only through adoption.


And if the father cannot be found.
Reply:If you used the father's last name as the babies on the birth certificate, then no. You have to get a Court Order allowing the name change. Call a family court lawyer and they can give you the specifics for your state.
Reply:Not if he is on the Birth Certificate! The court can change it without his consent, but there better be a good reason! Usually names are changed when deadbeat dad takes off, his rights are terminated and a new birth certificate is issued! Or he is convicted of some heinous crime!
