I am married and my baby has my husbands last name, well i want to give her to have her fathers last name how do i go about doing that. when my husbands name is on the B.C

To change any part of a baby's name or any part of the parent's names, a court order is necessary. The original document is sealed and a new document is created (example: Bryan Hernandez changed to Bryan Lee).





The entire process may take up to a year to complete. Begin by contacting the clerk of the Superior Court and ask about the name change packet. Once you have a certified copy of the order to change the name, file it with a completed Amendment to Reflect a Court Order Change of Name (form VS-23. A fee of $20 must be accompany the form and includes one certified copy of the amended record. All other instructions and the mailing address are on the back of the form (same as shown above).





I think that if you do it in the first 12 months you do not have to go through all the crap to do this, but I'm not sure. Contact the Office of Vital Statistics near you for more information.

Reply:You will have to retain a lawyer to see if you can do this. Legally, you can name your baby whatever you want, including giving him/her a different last name than yours or your husbands. This has to be done before the birth certificate is filed. If you want to change your baby's name you will have to file for a legal name change for her and there may be some trouble with legal issues if your husband is not the biological father of the child. Consult a lawyer as to the way to handle this situation in your state. Your husband will likely have to sign the papers as well since he is listed as the child's father. Is he OK with giving the baby another man's last name? If the baby's biological father is not an active part of her life but your husband is, then it would be respectful and appropriate for your daughter to have your husband's last name since he will most likely be the father figure in her life. A father is much more than the sperm donor.
